SPONSOR:

The Four Sigmatic January Sweepstakes (the “Sweepstakes”) is sponsored by Four Sigma Foods Inc., located at 606 Venice Blvd, Suite 210 Venice, CA 90291, US (“Sponsor”). This Sweepstakes is not sponsored, endorsed, or administered by Sony Interactive Entertainment, Inc. (“SIE”) or its related products, Home Box Office, Inc (“HBO”), WarnerMedia Direct LLC (“Max”) or The Last of Us. This Sweepstakes is not sponsored, endorsed, or administered by Meta Platforms, Inc. dba Meta or its related products, including but not limited to Instagram. 

BINDING AGREEMENT:

By entering or attempting to enter this Sweepstakes, participants (“Participants”) agree to abide by all terms of these Official Rules, applicable social media terms, and to be bound by the decisions of the Sponsor. All federal, state, and local laws apply. Failure to comply with the above may result in disqualification.

ENTRY PERIOD:

Entries into the Sweepstakes must be made between 10:00 a.m. Pacific Standard Time (PST) on Tuesday, March 25, 2025, and midnight PST on Monday, March 31, 2025 (the “Entry Period”). The Sponsor’s computer system is the official timekeeping device with respect to all matters relating to the Promotion. PST means the time in California on the dates in question.

ELIGIBILITY:

Open to all legal United States residents age 18 years or older. Employees, officers, directors, agents, or other representatives, members of their immediate families, and persons living in the same household of Sponsor, SIE, HBO, and Max are not eligible.

HOW TO ENTER/CREATE AN ENTRY:

Eligible entrants (“Entrants”) may enter by logging into their public Instagram account during the Entry Period (Entrant may create a non-private Instagram account for free if Entrant does not already have one) and take the following steps which together constitute a single entry (“Entry”):

• Follow @foursigmatic on Instagram

• Comment on the giveaway post with a 'tag' of another unique Instagram user

Each tagged user must be a different, unique account. Repeatedly tagging the same account will not count as additional entries.

Entrant must have a non-private Instagram account for their Entry to be publicly visible and entered in the Promotion.

If an Entrant enters from their wireless phone, the Entrant’s wireless service provider may charge the Entrant. Entrants should consult their wireless service providers regarding their pricing plans prior to entering. Message and data rates may apply.

In the event of a dispute regarding the identity of the individual entering the Sweepstakes or of the Winner of any Prize, the authorized account holder, as determined by Sponsor in its sole discretion, of the social media account used to participate in the Sweepstakes will be deemed to be the Entrant.

LIMIT:

Each Entrant can enter unlimited entries on their public Instagram account.

ODDS: 

The odds of winning will depend on the number of eligible entries.

USE OF ENTRIES:

By submitting an Entry, Entrant grants Sponsor an irrevocable, perpetual, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, display, and distribute the Entry in any and all media, now known or later developed, for marketing, advertising, or promotional purposes without additional compensation.

Entrant represents and warrants that:

• The Entry is original and does not infringe on the rights of any third party.
• Entrant has obtained any necessary permissions from third parties featured in the Entry.

USE OF PERSONAL INFORMATION:

By participating in the Sweepstakes, Entrant agrees that they are providing their information to Sponsor for the use of Entrant’s personal information by Sponsor for both online and offline direct marketing purposes, as well as for administration of the Sweepstakes including, without limitation, verifying Entrant’s eligibility, contacting Entrant regarding their Entry, awarding the Prize, avoidance of fraud/tampering, compliance with legal obligations, and analytics and improvement of offerings. INTELLECTUAL PROPERTY RIGHTS:

As between the Sponsor and the Entrant, the Entrant retains ownership of all intellectual and industrial property rights (including moral rights) in and to the entry (excluding the Sponsor’s rights in their respective trademarks and intellectual property).

WINNER SELECTION & NOTIFICATION:

On or about Thursday, April 3, 2025, Sponsor will randomly select one (1) potential prize winner (“Potential Winner”) using a third-party random generator from all timely submitted, eligible Entries received during the Entry Period.

The Potential Winner may be announced, subject to verification, on the Sponsor’s social media pages and/or website. The Potential Winner will be contacted via direct/private message within twenty-four (24) hours of selection. The Potential Winner must respond to the notification and fulfill any additional requirements, including signing and returning an Affidavit of Eligibility and Liability and Publicity Release, within twenty-four (24) hours of notification.

If the Potential Winner cannot be contacted or fails to meet the requirements, Sponsor will select a replacement from the remaining eligible Entries.

PRIZE:

One (1) grand prize consisting of:

• One (1) US Google Play Gift Card ($100 Value).

• One (1) Four Sigmatic ‘End of World Essentials’ Kit ($170 Value) consisting of:

  • One (1) Four Sigmatic tumbler ($20 Value).
  • One (1) Four Sigmatic coffee canister ($34 Value).
  • One (1) Four Sigmatic mushroom bag ($10 Value).
  • One (1) Healing Mushrooms book ($17 Value).
  • One (1) Four Sigmatic tarot deck ($30 Value).

Four (4) runner-up prizes consisting of:

• Three (3) Four Sigmatic HBO Original The Last of Us Organic High Caf Coffee bags ($60 value).
  

Approximate total retail value of all prizes: $570 USD.

Prizes cannot be exchanged or redeemed for cash, sold, or traded. No prize transfer, assignment, or substitution by Winner(s) is permitted. Sponsor reserves the right to substitute a prize of equal or greater value.

Winner(s) are solely responsible for all applicable taxes and fees. Any winnings over $600 will be reported to the IRS, and Winner(s) will receive a Form 1099.

DISQUALIFICATION:

Sponsor reserves the right to disqualify any Entrant found to be tampering with the entry process, violating the Official Rules, or engaging in unsportsmanlike conduct.

RELEASE OF LIABILITY:

By entering, Participants agree to RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Four Sigma Foods Inc., Meta Platforms, Inc. dba Meta, Sony Interactive Entertainment, Inc., Home Box Office, Inc., WanerMedia Direct LLC, and each of their respective affiliates and representatives from any claims related to participation in this Sweepstakes or use of the Prize.

DISPUTES; GOVERNING LAW:

All disputes will be governed by California law, and any legal actions must be filed in the state or federal courts located in San Francisco, California. Entrants waive any right to a jury trial and agree to resolve disputes individually.
